    These services are delivered digitally and may include training plans, video assessments, coaching calls, and instructional content.

    2.Eligibility

    You must be at least 18 years old or have parental/guardian consent to use our services. By agreeing to these terms, you confirm that you meet these requirements.

    3.Health Disclaimer

    Our programs are for informational and educational purposes. Consult with a healthcare provider before beginning any exercise or nutrition program. You participate at your own risk.

    4.Payment & Billing

    All payments must be made in full before any training program or coaching begins. No refunds will be issued once a program has been delivered, unless otherwise stated in writing.

    5.Refund Policy

    Due to the digital and personalized nature of our services, all sales are final. Refunds may be granted on a case-by-case basis for extenuating circumstances and at the discretion of Madriz Power & Performance.

    6.Client Responsibility

    You are responsible for:

    • Providing accurate information during assessments

    • Following the program instructions safely and consistently

    • Notifying your coach of injuries or health concerns

      7.Intellectual Property

    All materials (videos, PDFs, coaching plans, etc.) are the intellectual property of Madriz Power & Performance. You may not share, reproduce, or distribute this content without written permission.

    8.Coaching Commitment

    We are committed to delivering your training plan within 2–3 business days of assessment completion. Communication is expected to be respectful and professional on both sides.

    9.Modifications

    Madriz Power & Performance reserves the right to modify or discontinue services without notice. Updated terms will be posted on our website.

    10. Limitation of Liability

    Madriz Power & Performance is not liable for injuries, damages, or losses sustained through participation in any program. By using our services, you assume full responsibility for your actions and outcomes.

    11.Privacy Policy

    By purchasing, enrolling in, or participating in any program or service offered by Madriz Power & Performance, you agree to the following:

    1. Voluntary Participation

    I understand that participation in any fitness, strength training, conditioning, or coaching program provided by Madriz Power & Performance is entirely voluntary. I affirm that I am in good health and capable of performing the physical exercises associated with these programs.

    2. Assumption of Risk

    I recognize that physical exercise and athletic training involve inherent risks, including but not limited to:

    • Muscle strains and sprains

    • Heart complications

    • Falls and collisions

    • Equipment-related injuries

    • Aggravation of existing medical conditions

    I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained while participating.

    3. Medical Clearance

    I affirm that I have consulted a physician or medical professional, or have chosen not to, before beginning this program. I understand that Madriz Power & Performance is not a licensed medical provider and does not diagnose or treat medical conditions.

    4. No Guarantees

    I understand that results from training and coaching programs may vary and are not guaranteed. Outcomes depend on individual effort, consistency, and adherence to the prescribed plan.

    5. Release of Liability

    In consideration for participation in services provided by Madriz Power & Performance, I hereby release and discharge:

    • David Madriz

    • Madriz Power & Performance LLC

    • All associated coaches, affiliates, agents, and contractors

    From any and all liability, claims, demands, or causes of action, known or unknown, arising from injury, illness, or damages as a result of my participation.

    6. Use of Likeness & Testimonials

    I authorize Madriz Power & Performance to use any testimonials, progress updates, photos, or videos I voluntarily provide for marketing or educational purposes. No images or content will be used without my consent.

    7. Legal Acknowledgment

    This agreement is binding upon me, my heirs, assigns, and legal representatives. I acknowledge this release as a legal document and fully understand its contents.

    8. Electronic Signature

    By submitting this waiver electronically or checking the agreement box on any Madriz Power & Performance form, I confirm that I have read, understood, and voluntarily agree to the terms above.
